Animal Breeding Regulations 2024 (Registration + Certification of Breeders & Breeding Stock) Donald Rugira Kugonza Department of Agricultural Production (DAP) College of Agricultural and Environmental Sciences (CAES) Makerere University (Mak) Introduction ✓What is a regulation? ✓How does it differ from: ✓ A Policy ✓ A Bill ✓ An Act ✓ A Statute ✓ A Guideline A Policy ✓Is a deliberate system of guidelines to guide decisions and achieve rational outcomes. ✓A policy is a statement of intent and is implemented as a procedure or protocol. ✓Policies are generally adopted by a governance body within an organization. ✓E.g. Animal Breeding Policy (1997) A Bill ✓Is a draft law. ✓It may be proposed by an MP or Minister. ✓A Statute is a formal written enactment of a legislative body other than Parliament. ✓E.g. Animal Breeding Bill of March 2001 An Act of Parliament ✓Is a form of primary legislation. ✓Is a text of law passed by the legislative body of a jurisdiction in our case, The Parliament of Uganda. ✓Its a Bill that has been assented to by the President & must be published shortly after in the Gazette. ✓An Act takes effect when published in Gazette or on a date determined in the Act. E.g. Dec 2002 for the Animal Breeding Act, 2001. A Regulation ✓An authoritative rule. ✓Specifically, a rule or order issued by a government agency and often having the force of law. ✓Made to manage and control certain behaviours, activities, or processes within a particular area or industry. ✓Prescribe the conditions that have to be met for someone to be registered and licensed to engage in an activity according to the law A Statute ✓A formal written enactment of a legislative body. ✓Statutes command or prohibit something, or declare policy. ✓They are issued by government agencies and customary law (as opposed to case law that is decided by courts). ✓May originate with district or municipality. A By-law ✓Is passed by a Council, Committee or Board of Directors or a Community. ✓Is an Authoritative Order ✓Is implementable only within that society or community and cannot be enforced outside the community. ✓E.g. KCCA has a by-law/Ordinance on not grazing livestock in the city A Guideline ✓Is a statement by which to determine a course of action. ✓Aims to streamline particular processes according to a set routine or sound practice. ✓May be issued & used by an organization (govt/private) to make actions of employees more predictable, & of higher quality. ✓Is similar to a rule, but legally less binding as justified deviations are possible. ✓E.g. Guidelines f genetic evaluation & certification of bulls & bull dams of Uganda. A Protocol & A Procedure ✓Protocol: Is a predefined written procedural method of conducting experiments. ✓Procedure: Instructions or recipes, a set of commands that show how to achieve some result, such as to prepare or make something. Powers to develop & Enforce Breeding Regulations – ✓Animal Breeding Policy (1997): ✓Aimed at achieving a sustainable increase in the productivity of farm animals ✓Animal Breeding Act (2001): ✓Established the NAGRC&DB as the agency responsible for Animal Breeding in Uganda ✓Stipulates the Stakeholders in Animal Breeding ✓Who should be regulated; Offences & Penalties. Powers – S4. Functions of Director of Animal Resources: (a-k) ✓(i) Formulate & Enforce regulations+guidelines relating to the regulation of Breeding, Processing of semen and other genetic materials, Storage, Distribution, Marketing, Import & Export, and use in the public & private sector; S5. Additional Functions of the Director ✓(d) Develop and formulate regulations governing artificial insemination and embryo transfer techniques regarding qualifications and required standards; Powers – S48. Regulations: (1-3) ✓(1) Minister may, on recommendation of the Board, by statutory instrument, make regulations for the better carrying into effect of the provisions of the Animal Breeding Act. Who is the Regulator? – S6. Registration: (1-4) ✓(1) The Commissioner, Animal Production & Marketing in MAAIF shall be responsible for the Registration of animal genetic resources & related activities. ✓The Functions can also be delegated. S12. Special activities of certain Commissioners in MAAIF (2) The Commissioner, Livestock Health and Entomology (now Commissioner, Animal Health) shall, Who is the Regulator? – ✓S12(2)(d) Issue Import & Export permits for animal breeds & genetic materials. ✓Other regulators: • NAGRC & DB • Uganda National Council of Science & Technology (UNCST), and • Uganda National Bureau of Standards (UNBS) Who is to be Regulated? – S11. Registration & Regulation of Breeders & their Breeding Stock ✓(2) The following shall register with the Commissioner, Animal Production & Marketing on payment of the prescribed Fee contained in the 7th Schedule of the Act. ✓(a) inseminators; ✓(b) semen collection premises; ✓(c) importers and exporters of germplasm; Who is to be Regulated? – ✓(d) breed associations and breed societies; ✓(e) animals and their brands; ✓(f) breeding farms; ✓(g) breeders; ✓(h) embryo transfer technicians; ✓(i) premises for embryo transfer; Who is to be Regulated? – ✓(j) inovulators; ✓(k) training institutes relevant to animal breeding; ✓(l) hatcheries; ✓(m) animal genetic engineering premises; and ✓(n) any other thing or transaction deemed necessary under this What is in the Regulations then?? ✓There are 37 sub-regulations of the Draft Animal Breeding Regulations 2024; Name of the Regulations: ✓The Animal Breeding (Registration and Certification of Terrestrial Breeders, Premises, Assisted Reproductive Technology Service Providers and Breeding Stock) Regulations, 2024 Applications of the Regulations ✓ These regulations apply to a person and premises who – ✓ (a) intends to engage in the business of offering services of Artificial insemination, Embryo transfer, Inovulation and Animal breeding for any purposes of (for Personal farm use, Monetary, Academic, Research, Animal genetic consultants, Pedigree analysis and any approved purpose). Applications of the Regulations……. ✓ (b) intends to engage in the business of the supply of animal breeding equipment, inputs & breeding stock; ✓ (c) engages in animal germ cell collection, processing and handling, & operation of poultry hatchery for the purposes of selling offspring or products, as the case may be; ✓ (d) intends to register animal breeds & brands or donates animal genetic material. ✓ (e) Breed inspectors Registration Requirements ✓Filling an application form addressed to Commissioner Animal Production. ✓Having completed and passed O-level. ✓Having completed and passed AI training course from a recognized institution. ✓Proof of passing a theoretical and practical tests conducted by a recognized institution in Uganda – for foreigners. Registration Requirements……… ✓Having suitable premises as also approved by local authorities. ✓Paid registration fees – 3 currency points @ 20,000/=. ✓Letter of recommendation from a person in the field of breeding. ✓Work permit – for foreigners. Time for Processing Registration Application ✓The Commissioner to provide feedback within 45 days ✓Annual license for AI, ET, Inoculators, hatchery operators, dealers in animal genetic materials ✓Large animal breeders – 10 years ✓Small animal breeders – Goats, sheep & pigs – 5 years., Poultry & Rabbits – 4 years ✓Not allowed to practice in a field where you are not registered Renewal for the License ✓Application submitted 60 days prior to license expiry ✓Renewal fees – 1.5 currency points ✓Inspection/ Compliance report Refusal to Issue Certificate ✓If the applicant does not fulfill the requirements of these regulations and the Act; ✓If the applicant has been convicted of an offence involving dishonesty, fraud or any offence under these regulations; ✓If the applicant found and proved to be impersonating; or, ✓For any other reason as the commissioner may deem appropriate. Cancellation of Certificate of Registration ✓At any time if – (a) Registered person is deceased; (b) Registered business ceases to operate for two consecutive years; (c) Registered business operated in a manner that is non- compliant with the regulations, the Act and the conditions specified in the certificate of registration Cancellation of Certificate ……. NB. The affected person will be given chance to show cause as to why cancellation of a certificate should not take place. Suspension of Certificate ✓Suspension period ≤ 90/365 d ✓At the expiry of suspension, cancel the certificate of registration if satisfied that the reasons for suspension still exist or have not been sufficiently addressed. ✓A person whose certificate is cancelled or suspended shall not be authorized to conduct any business related to animal breeding. Inspection ✓Inspectors will be designated to do inspection during working hours. ✓May take animal genetic samples for laboratory analysis ✓Inspection and laboratory analysis will guide the Commissioner on the next course of action. Offences and Penalties ✓Obscuring an inspector; ✓Refusal to surrender cancelled certificate; ✓Involving in animal breeding activities without being registered; ✓Selling genetic material collected from his or her own animals to other person when he/she is not registered & licenced; ✓Being registered & sell genetic material of unregistered breeding animals; ✓Impersonation Offences and Penalties…………. ✓Continuing to engage in business after the expiry, cancellation or suspension of the certificate of registration; or ✓Providing false information under these regulations, PENALTY ✓On conviction, a fine not exceeding one hundred currency points or a term of imprisonment not exceeding two years or both. ✓ In addition, court may order that the animals & products in respect of which the offence has been committed be forfeited to the Government Duties owing to Registration ✓A person who is registered under these regulations shall- (a) Notify the registrar of change of location or address within fourteen days of making the change . (b) Keep breeding performance, health, population, feeding among other records; and (c) Submit to the Commissioner, annual performance reports. Review and Appeal ✓Any person who is aggrieved by the decision of the Commissioner under these Regulations, may- (a) Apply to the Commissioner to review his or her decision if that person has information that he or she thinks that if it was available to the Commissioner, the decision of the Commissioner would have been different; or (b) Appeal the decision of the Commissioner to the Chief Magistrates Court in the area of jurisdiction.
